Studi tanggapan masyarakat nelayan desa Kema III terhadap kebijakan penenggelaman kapal illegal fishing

Abstrak

Penenggelaman kapal illegal fishing yang terbukti melakukan praktek pencurian ikan telah memiliki dasar hukum yang kuat di Indonesia. Hal ini tertuang dalam Undang-Undang Nomor 45 Tahun 2009 Pasal 69 ayat 4 dan Pasal 76A Undang-Undang Perikanan menyebutkan penyidik dan pengawas perikanan dapat melakukan tindakan khusus berupa pembakaran atau penenggelaman kapal illegal fishing berbendara asing. Menurut Qodir dan Basuki 2014, illegal fishing secara sederhana berarti bahwa penangkapan ikan dilakukan dengan melanggar aturan-aturan yang telah ada, atau kegiatan penangkapan ikan dapat dikatakan illegal jika terdapat aturan-aturan tetapi ternyata dalam pelaksanaannya aturan-aturan tersebut tidak efektif ditegakkan di lapangan. Hal ini menunjukkan bahwa kegiatan illegal fishing merupakan kegiatan yang menyalahi aturan baik undang-undang dasar maupun hukum adat. Tujuan penelitan ini untuk mengetahui tanggapan masyarakat nelayan Desa Kema III terhadap kebijakan penenggelaman kapal illegal fishing, dan menganalisis tanggapan masyarakat nelayan Desa Kema III terhadap kebijakan Penenggelaman kapal dan illegal fishing. Penelitian ini dilakukan dengan mengikuti metode deskriktif yang meneliti suatu metode didasarkan pada studi kasus. Pengambilan data juga dilakukan melalui survei dengan menyebarkan kuesioner dan wawancara di lokasi penelitian. Hasil penelitian menunjukan dari 30 responden tanggapan tentang kebijakan penenggelaman kapal illegal fishing paling banyak menunjuk pada skor 4 yaitu “Setuju” dengan jumlah 16 orang. Alasan dari responden bahwa responden merasa dengan adanya kebijakan penenggelaman kapal illegal fishing yang dilakukan oleh Pemerintah dapat membuat hasil tangkapan nelayan Desa Kema III meningkat dan mengurangi tindakan illegal fishing.

Abstract

Sinking of illegal fishing vessels proven to have committed if has a strong legal basis in Indonesia. This article, especially in Law Number 45 of 2009 Article 69 paragrah 4 and Article 76A of the Law on fisheries staces that fisheries investigators and super visor can take specialis action in the form of burning or sinking illegal fishing vessels with foreign flags. According to Qodir and Basuki 2014, illegal fishing simply means that fishing is carried out in violation of existing regulation or fishing activities can be said to be illegal if there are regulations, but in realty , these rules are not effectively enforced in the field. This shows that illegal fishing is an activity that violates the rulers of both the constituation and customary law. The purpose pf this research is of find out the response of the fishing community in Kema III village tocthe illegal fishing policy and to analyze the responses of the fishing community in the Death Village to the boat sinking and illegal fishing policy. This research was conducted by following a descriptive method that examines a method based on case study. Data collection was also carried out through a survey by distributing questionnaires and interview at the research location. The result showed that from 30 respondents, the most respondenses about the policy of sinking illegal fishing boats. Showed that the highest score was 4, namely agreeing with the number of 16 people. The reason from the responden feels that the government has made the policy of sinking illegal fishing boats to increase the catch of ficherman in Kema III village and reduse illegal fishing.
