KAJIAN YURIDIS TERHADAP PEMBERIAN KREDIT BANK DENGAN PERSONAL GUARANTEE BANK SWASTA DI KOTA MANADO

Abstract

Individual award or Personal Guarantee Agreement is an accesoir of the principal agreement, which is a loan agreement. This can be seen in the provisions of Article 1821 of the Indonesian Civil Code which states "there shall be no cover if there is no legitimate engagement." Therefore, the provision of the Personal Guarantee shall refer to the principal agreement (credit agreement) which is borne by the guarantor). Perjanjian  jamian  perorangan  atau Personal  Guarantee adalah  suatu perjanjian  ikutan  (accesoir)  dari  perjanjian  pokoknya,  yaitu  perjanjian  utang piutang  (kredit).  Hal  ini  dapat  dilihat  dalam  ketentuan  Pasal  1821  KUHPErdata yang menyatakan “ tiada penanggungan jika tidak ada suatu perikatan pokok yang sah.” Oleh karena itu, pemberian Personal Guarantee harus menyebut perjanjian pokok  (perjanjian  kredit)  yang  mana  yang  ditanggung  oleh  pemberi  jaminan (peng- Guarantee) tersebut.
