PROSPEK PENYELESAIAN SENGKETA TAPAL BATAS INDONESIA MALAYSIA DI KAWASAN SEKTOR BARAT KALIMANTAN-SARAWAK

Meskipun Indonesia dan Malaysia merupakan dua bangsa serumpun, namun hingga kini masih sering terjadi permasalahan antara kedua negara. Salah satu permasalahan yang hingga kini belum terselesaikan adalah terkait dengan sengketa perbatasandarat, antara kedua negara mulai dari perbatasan yang ada di Provinsi Kalimantan Barat hingga wilayah Provinsi Kalimantan Timur. Sering muncul masalah terkait isu pergeseran dan pencabutan patok batas secara sepihak yang diklaim dilakukan oleh pihak lawan. Hal ini tidak terlepas dari dasar hukum dijadikan argumen dari masing-masing negara baik Indonesia dan Malaysia, perbedaan pendapat mengenai batas Negara oleh Indonesia dan Malaysia sering kali tidak mencapai titik temu. Terakhir 2018 lalu Indonesia dan Malaysia telah melakukan sedikitnya sembilan pertemuan teknik membahas demarkasi penyelesaian sengketa batas kedua negara. Penelitian mencoba untuk menganalisis prospek penyelesaian masalah tapal batas kedua Negara
khususnya di sector barat. Dari hasil penelitian menggambarkan prospek penyelesaian masalah tapal batas kedua Negara, suda mulai berjalan efektif. Tahap-tahap di dalam penyelesaian yang efektif yaitu negosiasi berdasarkan MoU yang beroreantasi pada traktat London.

PROSPECT OF DISPUTE SETTLEMENT OF THE INDONESIAN BATTLE OF MALAYSIA IN THE WEST SECTOR AREA KALIMANTAN-SARAWAK

ABSTRACT
Although Indonesia and Malaysia are two allied nations, there are still frequent problems between the two countries. One of the problems that has yet to be resolved is related to land border disputes, between the two countries starting from the borders in West Kalimantan Province to East Kalimantan Province. Problems often arise related to the issue of unilaterally shifting and removing boundaries claimed by the opposing party. This is inseparable from the legal basis used as an argument from each country both Indonesia and Malaysia, differences of opinion regarding the boundaries of the State by Indonesia and Malaysia often do not reach common ground. Last 2018, Indonesia and Malaysia had held at least nine technical meetings discussing the demarcation of the dispute resolution of the two countries. This research tries to analyze the prospect of solving the problem of the boundaries of the two countries, especially the western sector. The results of the study illustrate the prospect of resolving the border issue between the two countries, which has begun to run effectively. The stages, in an effective settlement, are negotiations based on an MOU that orientates in the London treaty.
