PENIADAAN PENUNTUTAN MELALUI RESTORATIVE JUSTICE SYSTEM DALAM PENYELESAIAN PERKARA TINDAK PIDANA KEKERASAN DALAM RUMAH TANGGA PADA TAHAP PENUNTUTAN

Abstract

ABSTRACT.

The aim of the research is to find out whether restorative justice can be applied in resolving criminal cases and to find out how to resolve domestic violence cases using a restorative justice approach at the prosecution stage. Using empirical juridical research methods, the conclusions obtained are: 1. Basically, there are no legislative arrangements that specifically regulate restorative justice in Indonesia, however in Indonesia there are regulations governing restorative justice issued by several legal institutions in Indonesia , just as the Prosecutor's Office issued PERJA No.15 of 2020 concerning Termination of Prosecution based on Restorative Justice, the National Police issued PERPOL No. 8 concerning the Handling of Criminal Acts Based on Restorative Justice, then the Supreme Court of the Republic of Indonesia issued a decision letter, SK Director General Badilum Ma Number: 1691/DJU/SK/PS.00/12/2020 concerning the Implementation of Guidelines for the Implementation of Restorative Justice.

ABSTRAK.

Tujuan penelitian adalah untuk mengetahui restorative justice dapat diterapkan dalam penyelesaian perkara tindak pidana dan Mengetahui cara penyelesaian perkara kekerasan dalam rumah tangga menggunakan pendekatan restorative justice dalam tahap penuntutan. Dengan metode penelitian yuridis empiris, kesimpulan yang didapat: 1. Pada dasarnya pengaturan perundang-undangan yang mengatur secara spesifik tentang restorative justice belum ada di Indonesia, namun di Indonesia telah ada peraturan yang mengatur tentang keadilan restoratif yang di keluarkan oleh beberapa lembaga hukum di Indonesia, seperti Kejaksaan mengeluarkan PERJA No.15 Tahun 2020 tentang Penghentian Penuntutan berdasarkan Keadilan Restoratif, Polri mengeluarkan PERPOL No. 8 tentang Penanganan Tindak Pidana Berdasarkan Keadilan Restoratif, kemudian Mahkamah Agung Republik Indonesia mengeluarkan surat keputusan, Sk Dirjen Badilum Ma Nomor : 1691/DJU/SK/PS.00/12/2020 tentang Pemberlakuan Pedoman Penerapan Keadilan Restoratif ( Restorative Justice).
