RESPONS AUSTRALIA TERHADAP AKTIVITAS PENANGKAPAN IKAN NELAYAN INDONESIA DI WILAYAH ASHMORE REFF

Isu aktifitas nelayan tradisional Indonesia di perairan Australia telah berulangkali menimbulkan persoalan dalam hubungan bilateral kedua negara. Konvensi Hukum Laut (UNCLOS), dan nota kesepakatan Indonesia-Australia atau MoU Box 1974, sesungguhnya telah memberikan jaminan hukum atas hak penangkapan ikan tradisional oleh nelayan-nelayan tradisional Indonesia di perairan Australia yang telah mereka lakukan secara turun menurun sejak sekitar abad 17. Namun fakta empiris memperlihatkan adanya praksis berbeda. Nelayan-nelayan tradisional Indonesia tersebut masih menghadapi hambatan dalam melaksanakan hak perikanan tradisionalnya akibat perbedaan penafsiran hak penangkapan ikan tradisional dan perubahan kawasan area yang disepakati dalam MoU Box oleh pihak Australia. Dengan menggunakan perspektif dari Indonesia, kajian ini dimaksudkan untuk memahami persoalan tersebut sebagai bahan pijakan untuk mencari solusi atas permasalahan tersebut. Persoalan ini perlu mendapatkan perhatian serius dari pemerintah. Tidak saja untuk kepentingan menjaga hubungan bilateral Indonesia-Australia, tetapi yang jauh lebih penting adalah untuk memberikan jaminan keamanan dan kesejahteraan nelayan-nelayan tradisional kita.

ABSTRACT
The issue of Indonesian traditional fishing activities in Australian waters has repeatedly caused problems in bilateral relations between the two countries. The Law of the Sea Convention (UNCLOS), and the Indonesia-Australia memorandum of understanding or MoU Box 1974, have actually provided legal guarantees for traditional fishing rights by Indonesian traditional fishermen in Australian waters which they have been doing in decline since around the 17th century. empirical facts show that there is a different praxis. These Indonesian traditional fishermen still face obstacles in exercising their traditional fishery rights due to differences in interpretations of traditional fishing rights and changes in the area agreed in the MoU Box by the Australian side. Using a perspective from Indonesia, this study is intended to understand these problems as a basis for finding solutions to these problems. This issue needs serious attention from the government. Not only in the interest of maintaining bilateral relations between Indonesia and Australia, but what is far more important is to guarantee the safety and welfare of our traditional fishermen.
