KEBIJAKAN PEMERINTAH TERKAIT PERIZINAN PEMBANGUNAN SARANA TELEKOMUNIKASI

Abstract

ABSTRAK

Seiring dengan perkembangan kebutuhan akan sarana telekomunikasi, telah mendorong meningkatnya tuntutan pembangunan infrastruktur sarana telekomunikasi yang perlu dilakukan oleh penyedia jasa telekomunikasi. Terkait dengan itu banyak dijumpai pembangunan sarana telekomunikasi yang begitu agresif yang dilakukan oleh pelaku usaha telpon seluler telah mengakibatkan gesekan-gesekan dengan masyarakat. Penyebab terjadinya benturan tersebut karena disatu sisi penyedia jasa telekomunikasi ingin memberikan pelayanan terbaik dengan membangun menara (tower) di dekat pemukiman warga, sedangkan warga justru sering merasa terganggu keamanan dan kenyamanannya terkait dengan pembangunan menara telomunikasi tersebut. Oleh karena itu agar dalam proses penderian menara telekomunikasi tersebut berjalan dengan baik dan lancar maka diperlukan adanya suatu aturan dan perijinan yang harus dipenuhi oleh penyedia jasa telekomunikasi. Dengan menggunakan metode kualitatif penelitian ini akan mencoba melihat bagaimana pengelolaan perijinan pembangunan menara/ tower telekomunikasi yang dilakukan oleh pemerintah Kabupaten Minahasa Selatan. Dari temuan penelitian pengelolaan perijinan yang dilakukan oleh Pemerintah Kabupaten Minahasa Selatan berpatokan sebagaimana yang telah diatur dalam Peraturan Menteri Komunikasi dan Informatika (Permenkominfo) Nomor:02/Per/M.Kominfo/03/2008, tentang Pedoman Pembangunan dan Penggunaan Menara Bersama Telekomunikasi. Namun pemerintah Kabupaten Minahasa Selatan belum memiliki Rencana Tata Ruang Wilayah (RTRW), Rencana Detail Tata Ruang (RDTR), Rencana Tata Bangun dan Lingkungan (RTBL), dan peraturan daerah tentang bangunan gedung. Akibatnya, penempatan menara itu terkadang masih tidak sesuai dengan ketentuan. Seperti misalnya jarak menara tower dengan kawasan pemukiman harus menjamin kesehatan masyarakat, atau jarak menara tower ke bangunan terdekat adalah sebesar minimum tinggi bangunan tower, yang bertujuan menjaga keamanan masyarakat, apabila sewaktu-waktu menara itu rubuh tidak akan mengenai bangunan rumah warga.

ABSTRACT

In line with the development of the need for telecommunications facilities, this has led to the increasing demands for telecommunication infrastructure development that need to be carried out by telecommunication service providers. Related to that, there have been many cases of aggressive development of telecommunication facilities carried out by cellular telephone business actors which have resulted in friction with the community. The cause of the collision was because on the one hand the telecommunication service providers wanted to provide the best service by building towers near residential areas, while residents often felt their security and comfort was disturbed in connection with the construction of the telecommunication tower. Therefore, in order for the process of obtaining the telecommunication tower to run well and smoothly, it is necessary to have a regulation and license that must be fulfilled by the telecommunication service provider. By using a qualitative method, this research will try to see how the licensing management of telecommunication tower / tower construction is carried out by the South Minahasa Regency government. From the findings of the licensing management research conducted by the South Minahasa Regency Government, based on the regulations stipulated in the Regulation of the Minister of Communication and Information Technology (Permenkominfo) Number: 02 / Per / M.Kominfo / 03/2008, regarding Guidelines for the Construction and Use of Telecommunication Joint Towers. However, the South Minahasa District government does not yet have a Regional Spatial Plan (RTRW), Detailed Spatial Planning (RDTR), Environmental and Construction Planning (RTBL), and regional regulations regarding buildings. As a result, the placement of the towers is sometimes not in accordance with the regulations. For example, the distance between the tower and the residential area must ensure public health, or the distance between the tower and the nearest building is the minimum height of the tower building, which aims to maintain public safety, if at any time the tower collapses it will not hit the residents' houses.
